  1. Can granny flats be approved without council approval?

Yes, in many cases a granny flat can be approved without council approval. In 2009, the NSW Government released the state environmental planning policy (SEPP) for Affordable rental housing. This allows properties to build a secondary dwelling, also known as a granny flat through the Complying Development Certificate (CDC). 

  1. What are the requirements to get a granny flat approved by complying development?

There are some basic requirements for a granny flat to be approved via a complying development. These include:

  • Property must be zoned residential
  • Block must be 450m2 or larger
  • Maintain a 3.0m setback from the rear and 0.9m from the side boundaries for blocks of land less than 900sqm. These setbacks increase for larger blocks of land.
  • The granny flat must be a maximum of 60sqm.

While these are the minimum factors to get a granny flat approved without council approval, it is important to know that you can get a granny flat approved via Central Coast council. While the traditional DA approval process through council is typically slower than CDC, it does allow some flexibility with some of the rules set out above.
